Terms of Service

These Terms of Service ("Terms") govern your use of the website management services ("Service") provided by Golf Ping ("we", "us", "our"). By subscribing to the Service, you ("Customer", "you") agree to be bound by these Terms.

1. Service Description

Golf Ping provides managed website services for golf courses, including:

• A custom-designed website hosted on a domain of your choice
• Newsletter and course update management tools
• Same-day website updates upon request
• Ongoing hosting, maintenance, and technical support

2. Subscription & Payment

• The Service is billed monthly at the rate agreed upon at the time of subscription.
• Payment is processed automatically via Stripe on each billing cycle.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial months.

3. Customer Data & Privacy

• We will never sell, share, or distribute your data or your customers' data to third parties.
• All content you provide (logos, images, text, contact information) remains your property.
• We collect only the information necessary to provide the Service (business name, contact info, website content, payment details via Stripe).
• Newsletter subscriber data collected through your website is accessible to you and is used solely for your course communications.

4. Website Ownership & Intellectual Property

• The website design, templates, and underlying code are the intellectual property of Golf Ping.
• Your content (text, images, logos, branding) remains your intellectual property.
• Your custom domain remains your property. If you cancel, you retain full ownership of your domain.

5. Service Availability & Termination

• We strive for 99.9% website uptime but do not guarantee uninterrupted service.
• Golf Ping reserves the right to terminate or suspend the Service at any time with 30 days written notice.
• In the event of termination by Golf Ping, you will receive a pro-rated refund for any unused portion of your current billing period.
• Upon termination, we will provide a reasonable transition period (minimum 30 days) for you to migrate your content.

6. Acceptable Use

You agree not to use the Service to:

• Publish content that is illegal, defamatory, or infringes on third-party rights
• Distribute spam or unsolicited communications through the newsletter tools
• Attempt to access or modify the underlying website infrastructure

7. Limitation of Liability

To the maximum extent permitted by law, Golf Ping shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the three (3) months preceding any claim.

8. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect via the email address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
